Mediation

Conflict is inherent in virtually every situation. It takes place in families, in friendships, neighborhoods and in our business relationships. These conflicts often escalate with the emotions and feelings behind the issues involved in the dispute. The parties themselves easily resolve some of the conflicts. However, many of these disputes go into the court system and end up costing the disputants money, time, stress and often a valuable relationship. Mediation is an alternative to that process.

What is mediation? Mediation is a form of alternative dispute resolution in which the parties come up with a mutually agreeable solution to their disagreement. An impartial third party, known as a mediator, facilitates this process of assisted negotiation. Mediation offers the parties a relatively inexpensive way to resolve their conflicts at an early stage in the dispute. It gives the participants an opportunity to avoid some of the time, expense and stress involved in litigation and grievance procedures and it helps them maintain valuable business and/or personal relationships.

Mediation differs from litigation or arbitration in that the parties themselves own the process and have the power to decide whether and when to compromise. The mediator, a neutral third party, helps them identify issues and interests, vent anger and frustration, negotiate effectively, and find creative solutions to their problems.
